** CONTRACTS **

Part 1

Whereas Peggy Donovan (hereinafter called the “Breeder”) offers for sale a Labrador Retriever described as follows: 

1st Name Choice:  LINDENHALL’S___________________________________________________ 

2nd Name Choice: LINDENHALL'S___________________________________________________

 3rd Name Choice:  LINDENHALL’S___________________________________________________

*Must include the kennel name of Lindenhall at the beginning.  Cannot exceed thirty characters including spaces, no numbers allowed.

                 Now therefore ownership will be transferred to the buyer on the following terms, conditions and warranties, no other warranties or conditions are either expressed or implied:

1.                   The consideration of this sale is $750.00 + $60.00 PST ($810.00) payable in cash or by cheque (PAYABLE TO:  PEGGY DONOVAN) to be paid before the puppy leaves the breeder’s possession.

2.                   The Breeder, at her expense, shall duly register ownership of the puppy with the Canadian Kennel Club, in the Buyer’s name and provide the Buyer with a certificate of ownership; said puppy to carry the breeder’s kennel name:  LINDENHALL’S.  The registration certificate will be forwarded to the buyer in approx. 3-5 months.

3.                   This puppy was examined by a veterinarian and has been vaccinated with partial or all shots (depending on age).  A veterinary certificate to that effect is enclosed.  All Lindenhall puppies are sold on a three-day trial period.  If the Buyer is not satisfied with the puppy within the three days of purchase, the Buyer can return it at their expense for a full refund, provided the puppy is returned in the same condition as at the time of purchase.

4.                   The Breeder shall a) provide a replacement puppy (as soon as available) to any animal that has to be euthanized due to severe dysplasia before the age of two years OR b) if the buyer elects to have surgery done on the animal, a one time only payment of $350.00 will be given (acceptance of the cash payment forfeits replacement puppy).  A second x-ray by another veterinarian may be required before a replacement or payment is given.  If it is found that there was excessive stress previous to the two years of age (i.e. jogging, jumping, overweight, pregnancy etc) the above guarantee does not apply.  Results from the Penn-Hip exam are not accepted.  If the animal has to be euthanized or dies from any other genetic defect before the age of two years a full report from your veterinarian must be forwarded to my veterinarian for verification before a replacement will be given.  Any other replacements are at the Breeder’s discretion.  NO REFUNDS WILL BE GIVEN.  All veterinary, transportation expenses etc. will be paid by the Buyer.

5.                   Pet puppies to be spayed/neutered (see enclosed article) by the age of 12 months.  Where applicable, the Buyer agrees to sign a Canadian Kennel Club Non-Breeding Contract as of the date hereof.  The Buyer agrees that he/she will not use the herein animal for breeding.  Anyone wishing to breed this animal must sign a separate breeding contract.

6.                   The Buyer states that he/she is not acting as an agent in the purchase of the puppy, and will not be sold to an agent or pet shop nor will this dog be sold or given away, so as to be used as a prize or in a raffle.

7.                   The Buyer agrees that if for any reason he/she must dispose of the herein animal, the Breeder will be notified before any such action is taken.  The Breeder will have the right of the first refusal to purchase the animal at the original purchase price (minus expenses) or assist in relocating the animal to a suitable home.

8.                   It is understood and agreed that this contract is made and signed by all parties to ensure the well being and protection of this animal.  The Buyer agrees to keep the dog in the proper physical condition, to keep all vaccinations up to date and to provide a safe environment for the animal (i.e. kennel run, fenced yard, not running loose).  If in the opinion of the Breeder the animal is at risk due to actions of the Buyer, the Breeder will repossess the animal with full, partial or no refund of the purchase price (Breeder’s discretion).  All papers including the CKC and/or AKC registration certificate(s) will be returned to the Breeder at the time of repossession.  Should it be necessary to enforce any part of this contract by legal means, all expenses will be the responsibility of the Buyer.  No part of this contract is transferable.

Part 2

Genetic Defects

 The majority of my puppies go as family pets so I require all my dogs to have the typical sweet happy go-lucky Lab personality as well as the natural retriever instincts and a sound body.  As we are all aware, there are no guarantees in life, unforeseen tragic events happen to everybody and everything all the time.  As a breeder, I’ve taken advantage of what is readily available to be by way of x-raying, ophthalmologist testing, studying pedigrees of all my stock before breeding to ensure the best puppy that I can produce.  However, due to hidden recessive genes, there is always going to be a small risk of some genetic problems cropping up.  

By signing this statement I/we hereby acknowledge that an outline of some of the possible genetic defects have been explained and understand that there is a small risk of a genetic defect.

Part 3

Breeding

The Breeder agrees to lift the Canadian Kennel Club Non-Breeding Contract at her expense only when all of the following conditions have been met by the Buyer:

                         1.       This animal is over 18 months of age.

2.       This animal is free from any disqualifying or known genetic defects.

3.       Must have the hip, elbow and eye clearances done and copies of those certificates must be forwarded to the Breeder.

4.       This animal will only be bred to a mate with the same conditions as 1 through 3 above.

5.       The Breeder receives either one first pick puppy or $750.00.

6.       All puppies resulting from any breedings will not be sold to an agent or a pet shop, or be sold or given away as a prize or in a raffle.

7.       A female may only be bred up to 4 times and by the age of 7 years.
